Africa Cyber Defense Forum, with registered offices at Woodland office park. Woodlands Grove, Nairobi, Kenya. (the “Forum”, “we”, “our” or “us”) is an independent continental platform for public-private cooperation, committed to  passionate pursuit of better, secure and safer technology and  shaping of  the future of information security through progressive and inspiring conversations in technology. We offer thought leadership to both governments, society and private sector across the African continent.

The forum through its well curated and world class content, engages Top level Government officials, Technology experts, business leaders and other leaders of society to shape the continental, regional and industry agendas in the African cyber space.

The Forum owns, operates and makes available the website www.africacyberdefenseforum.com as well as subdomain websites and digital platforms (hereinafter “Website”/“Websites” and collectively “Digital Content”). The Forum makes them available to the users of the Digital Content (individually “you” or “Visitor” and collectively “Visitors”) under the following Terms of Use:

1. Agreement to the Terms of Use
Digital Content may contain features including blog, report and newsletter services, event, issue and community pages, member areas, digital platforms (including features for purposes of analyzing our Digital Content, its availability and accesses to it) and other applications that may be available from time to time. Please read these Terms of Use carefully before accessing to Digital Content. These Terms of Use contain conditions, disclaimers and other provisions, some of which limit the Forum’s liability. By registering and accessing Digital Content you explicitly agree to be bound by these Terms of Use.

2. Account Registration
Before accessing Digital Content, you are required to create an account with us. You will need to provide certain information as part of the registration to access and use the features of the Digital Content as a Visitor. Information provided for registration must be accurate, correct and up-to-date. We reserve the sole right to verify and deny access where information you provide us is incomplete, incorrect, inappropriate and/or missing.

You agree to be responsible for maintaining the confidentiality of your passwords or other account identifiers which you choose and all activities that occur under your account. By registering you agree that:

1. Your account and password are personal to you and may not be used by anyone else to access the Digital Content;
2. You will not do anything which would assist anyone who is not a registered user to gain access to any registration area of the Digital Content; and
3. You will not create registration accounts for the purpose of abusing the functionality of the site, or other users; nor will you seek to pass yourself off as another user.

You agree to notify us immediately if you become aware of any unauthorized use of your password or account identifiers by others.

3. Termination and Suspension of Digital Content account
If you no longer wish to be subscribed to the free version of Digital Content, you may terminate your account by sending an email to info@africacyberdefenseforum.com . If you no longer accept these Terms of Use, or any future modification to these Terms of Use, you must cease using the Digital Content. Continued use of the Digital Content indicates your continued acceptance of these Terms of Use.

If, for any reason, we believe that you have not complied with these Terms of Use, we may, at our sole discretion, cancel your access to the Digital Content immediately and without prior notice. We may also terminate your account, at our sole discretion, by emailing you at the address you have registered stating that account has been terminated.

4. Appropriate Use
Visitors shall not use the Digital Content to (i) post, submit or otherwise distribute unlawful, defamatory, abusive, obscene or offensive materials (ii) attempt to decipher, decompile, disassemble or reverse engineer transformation maps, (iii) violate Forum’s or third party rights including, but not limited to intellectual property or privacy rights (iv) access or attempt to access the Digital Content using interfaces aside from the ones provided by the Digital Content, (v) limit or constrict the availability or quality of the Digital Contents’ features.

In case of violation of this Section 3, the Forum reserves the sole right to take any actions, including but not limited to preclude your access to the Digital Content.

5. Disclaimer
THE DIGITAL CONTENT IS PROVIDED “AS IS” AND “AS AVAILABLE” WITH NO EXPRESS OR IMPLIED WARRANTIES OF ANY KIND INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY, NON-INFRINGEMENT, AND TITLE. THE FORUM DISCLAIMS ANY AND ALL LIABILITY FOR THE ACTS, OMISSIONS AND CONDUCT OF ANY THIRD PARTIES IN CONNECTION WITH OR RELATED TO VISITORS` USE OF THE SITE. VISITORS ASSUME TOTAL RESPONSIBILITY FOR THEIR USE OF THE SITE AND ANY LINKED SITES. IF THIS DISCLAIMER IS NOT ENFORCEABLE UNDER APPLICABLE LAW, IT MAY BE MODIFIED AT THE FORUM’S SOLE DISCRETION TO A FORM THAT IS ENFORCEABLE.

THE FORUM DOES NOT TAKE RESPONSIBILITY FOR THE CORRECTNESS, COMPLETENESS, UP-TO-DATEDNESS OR QUALITY OF THE INFORMATION PROVIDED IN THE DIGITAL CONTENT. ESPECIALLY, THE OPINIONS EXPRESSED IN THE CONTENT CONTAINED IN THE DIGITAL CONTENT ARE THOSE OF THE RESPECTIVE AUTHORS FOR THE DIGITAL CONTENT AS SHOWN. THEY DO NOT NECESSARILY REFLECT THE POSITIONS OF THE FORUM. THE FORUM EXPRESSLY DISCLAIMS ANY AND ALL LIABILITY TO ANY PERSON IN RESPECT OF ANYTHING DONE OR OMITTED TO BE DONE WHOLLY OR PARTIALLY IN RELIANCE UPON THE CONTENTS OF THE DIGITAL CONTENT.

FURTHERMORE, THE FORUM IS NOT LIABLE FOR ANY DAMAGE OR CORRUPTION CAUSED BY VIRUSES (OR SIMILAR MECHANISMS SUCH AS WORMS, LOCK OUTS, METERING, OR SELF-DESTRUCT MECHANISMS) ON COMPUTERS OR OTHER TERMINAL EQUIPMENT IN CONNECTION WITH VISITING, USING AND/OR DOWNLOADING DATA OF ANY KIND FROM THE DIGITAL CONTENT. THE VISITORS ARE PERSONALLY RESPONSIBLE FOR PROTECTING THEIR EQUIPMENT APPROPRIATELY FROM VIRUSES AND OTHER RISKS ON THE INTERNET.THE FORUM RESERVES THE RIGHT, AT ITS SOLE DISCRETION, BUT DISCLAIMS THE OBLIGATION, TO MONITOR AND/OR REMOVE CONTENT FROM ANY BLOG.

6. Limitation of Liabilities
The Forum will not accept responsibility for any indirect, incidental, collateral, or punitive damages that may incur from usage of the Digital Content, even if the Forum is already aware of the potential risks

7. Intellectual Property Rights
The Forum publishes its own content as well as links, content, photographs, graphics, logos and resources provided by third parties and content that has been specifically commissioned by the Forum for publication on the Digital Content.

The Forum is using the proprietary rights of third parties (including but not limited to the photographs and graphics). Due to limited space on the Digital Content, Reuters Photography, iStock and Shutterstock are the third parties who are credited herein. All proprietary rights relating to any third party links, content, photographs, graphics, logos or resources published on the Digital Content remain with the original source or the author(s) of that material and where any content has been commissioned by the Forum for publication on the Digital Content, any proprietary rights in such content remain with the relevant author, unless otherwise agreed or specified.

For all other content published on the Digital Content, the Forum reserves all proprietary rights including, but not limited to, copyrights, trademarks and other intellectual property rights in and to all content on the Digital Content; this includes all text, graphics, photographs, logos and/or other items that appear on the Digital Content. The Forum also reserves its rights over the Digital Contents’ template, including its layout, image and structure.

8. Privacy Policy and Data Protection
The Africa Cyber Defense Forum (hereafter the “Forum”) is committed to complying with data protection laws and to the protection and confidentiality of the personal data of users of our digital online platform(s) (hereinafter also referred to as “User”, “you” or “your”).

Privacy Policy

1.0 General Privacy Policy

1.1. Purpose
Data protection is a question of trust, and your trust is important to us. We respect your private life and privacy. It is a major concern for Africa Cyber Defense Forum (hereinafter referred to as “ACDF” or “we” or “us”) that your personal data is treated in a responsible manner and in compliance with the legal requirements.

The present data protection declaration (hereinafter referred to as “this Declaration”) describes how we process your personal data. This Declaration applies to and constitutes an integral part of a contract if it is listed in a contract document as an integral part thereof or referred to in the applicable General Terms & Conditions (GTCs). In the event of discrepancies between this Declaration and the GTCs, the provisions of this Declaration will have precedence. If you already use ACDF products and services, this Declaration will apply to personal data about you collected and stored by ACDF in the past, which we may connect to and process together with personal data collected in the future.

By accepting this Declaration, you consent to us processing your personal data in accordance with the relevant data protection and telecommunications legislation as well as the following provisions.

1.2. Data processing for service provision and contract execution
ACDF collects, stores and processes the personal data of its customers to the extent necessary to manage the customer relationship, provide its services, process orders and contracts, for billing, to answer questions, address concerns, provide support with technical issues and evaluate, improve and develop ACDF goods, services and functions. Personal data constitutes all information relating to an identified or identifiable person.

ACDF collects, stores and processes technical data during your use of our information and technology services. Technical usage data may be processed in a personally identifiably form for the following purposes where listed below in this Declaration or you have consented thereto by using a service.

1.3. Data processing for ACDF marketing purposes
We process your personal data for marketing purposes such as general customer communications and the personalization of offers from ACDF.

1.3.1. Data we process for marketing purposes
Data you provide in the context of our contractual relationship and data about our Web pages:
• Identification and contact data such as your first name and surname, telephone number, e-mail address, and profession;
• Customer activity data such as the type of our products and services that you use, the type and extent of your usage thereof, customer preferences, customer service information such as service requests;
• Online data such as the time and date on which our Web page was accessed, the name of the accessed Web page, the IP address of your computer or mobile device, the address of the Web page from which you accessed our Web page, information entered on forms, clicks on content on the Web page,
• ACDF pages on social networks, including the duration and frequency of the visits to these, as well as search terms, ratings and comments made. This data is procured in accordance with the online data protection Declaration for our Web pages.

1.3.2. Customer segments and profiles
To enable us to provide you with advertising, communications and offers better tailored to your needs as a customer, we create customer segments and customer profiles. To this end, we combine and analyze the data relevant for our marketing purposes.

1.4. Right to object
You may at any time refuse the use of your data for marketing and communications purposes. In this case, we will not process data for this purpose.

You can always unsubscribe from our email communications, by clicking on the “Unsubscribe” link on the footer of the emails.

You may also request the removal of your data from our systems, by submitting a request addressed to dpo@africacyberdefenseforum.com. Upon receiving the request, all data already stored for this purpose will be deleted within maximum two working days, and you will receive a confirmation by email.

You may refuse the processing of online data according to the information provided on the ACDF Web. There is no right to refuse general advertisements on Web pages.

1.5. Data processing abroad by commissioned third parties
ACDF might rely on foreign suppliers and service providers to process marketing communications, that may be located in the United States or other countries whose data protection legislation provides less protection than that afforded in our countries of operation. In this case, we ensure suitable protection in accordance with different data protection laws, acts and regulation across all territories of our operations, for example by concluding what are known as “EU model clauses” with the recipients of this data. These clauses are a series of provisions introduced by the European Commission to afford suitable protection to personal data when it is transferred across borders.

1.6. Your rights regarding your personal data
You have the right to obtain information in writing and free of charge about the personal data of yours that we process. Your request for information must be issued in writing, include a copy of your ID card or passport and be sent to our postal address.

You likewise have the right to request the correction of incorrect personal data. You may also demand the deletion of your personal data unless the applicable laws and regulations oblige us to store your personal data.

Lastly, you have the right to revoke your consent to the processing of your personal data at any time and/or refuse the processing and storage of your personal data by following the procedure detailed in the “Right to object” point above.

1.8. Applicability, duration and modification
We reserve the right to change or add to this Declaration at any time as we see fit. Should a change to this Declaration prove disadvantageous for you, we will notify you appropriately in advance and seek your consent. Your consent is granted voluntarily. Should you disagree with a specific change or addition, you may object to it. Should you fail to object by the aforementioned deadline, this will be deemed tacit acceptance on your part of the relevant change or addition. Changes or additions to the present Declaration shall not constitute grounds for extraordinary termination of service agreements.
